Overview

These Terms of Service govern your use of the West Will Rise online store and purchases made through it. References to “West Will Rise,” “we,” “us” and “our” refer to the business operating this store.

By using the store or placing an order, you agree to these terms and the policies referenced here, subject to applicable law.

Using Our Store

You must be legally capable of entering into a purchase agreement, or have the involvement and authorization of a parent or guardian where permitted by law.

You agree to provide accurate information and use the store lawfully. You must not interfere with its operation, attempt unauthorized access, introduce malicious software, or use fraudulent payment information.

Products and Descriptions

Our products are made to order using third-party production and fulfillment partners.

We aim to present accurate descriptions, size information and product images. Images may include digital mockups. Screen settings and the printing process can cause minor differences in appearance.

Such variations do not excuse supplying the wrong item, materially misdescribed goods or products that fail to meet applicable legal requirements.

Please review the product description and size chart before ordering. Availability may vary by size, colour, product and destination.

Prices and Payment

Prices are displayed in the currency indicated on the store or at checkout. Applicable shipping charges and taxes are disclosed before you complete your purchase. Any disclosed import duties or other destination charges may be additional.

Prices and offers may change for future orders. Changes do not alter an order already accepted, except where agreed with you or permitted by law.

Payment must be authorized using an accepted payment method.

Orders and Availability

After ordering, you will receive an order confirmation. If we identify a significant pricing error, unavailable product, suspected fraud or another issue preventing fulfillment, we will contact you.

We will not impose a higher price or substitute a materially different product without your agreement. If we cannot fulfill your order, we will refund amounts paid for the unfulfilled portion, including associated charges where appropriate.

Changes and Cancellations

Because products are made to order, please check all selections and delivery details before completing checkout.

We do not offer change-of-mind cancellations. If you discover an error, contact us immediately. Changes may be possible before production begins, but cannot be guaranteed.

This provision does not restrict cancellation rights provided by applicable law.

Shipping and Delivery

Our Shipping Policy forms part of these terms. Products may be manufactured and shipped by fulfillment partners from locations outside your province or country.

Production and transit estimates are provided separately where applicable. We will communicate material delays when we become aware of them and provide any remedies required by law.

Final Sale, Product Issues and Refunds

Purchases are final sale under our Return and Refund Policy. We do not accept routine returns or exchanges for change of mind, incorrect customer size selection or similar reasons.

Misprints, manufacturing defects, damage on arrival and orders lost in transit are reviewed individually under that policy. Your mandatory consumer rights remain unaffected.

Privacy and Shopify

Our store is hosted by Shopify. Personal information is handled as described in our Privacy Policy.

Depending on the features enabled, Shopify may process information about your activity on this store together with information from your interactions with Shopify and other merchants to provide enhanced services, personalization, analytics and advertising. Information may be processed by Shopify and service providers in other countries. Our Privacy Policy explains relevant practices and available choices.

Intellectual Property

Store branding, original artwork, photographs, text and other content are owned by us or used under applicable permissions or licences, to the extent protected by law.

Purchasing a product does not transfer intellectual property rights in its design. Unauthorized commercial reproduction of protected content is prohibited. This does not restrict uses permitted by law.

Third-Party Services

The store may link to third-party websites or services. Their own terms and privacy practices apply when you use them. Our use of payment, production or shipping providers does not remove our responsibilities to you as the seller.

Responsibility and Consumer Rights

We remain responsible for our obligations under applicable law. Nothing in these terms excludes mandatory warranties, remedies or liability that cannot lawfully be excluded.

Governing Law

These terms are governed by the laws of Alberta and applicable federal laws of Canada, subject to any mandatory protections and rights available under the laws applicable to you.

Nothing here requires you to waive access to courts or other remedies available by law.

Changes to These Terms

We may update these terms by publishing a revised version. Changes apply prospectively and do not retrospectively remove rights attached to existing orders.
